1. Introduction
Welcome to SteadyResourcePath ("we," "us," or "our"). The following Terms & Conditions ("Terms") apply to your use of our yacht charter services and the website located at steadyresourcepath.site (the "Service"), which is provided by SteadyResourcePath.
By securing a booking or utilizing our Service, you accept these Terms. Should you reject any section of the terms, access to the Service will be denied to you.
2. Service Overview
SteadyResourcePath offers luxury yacht charter services, which include a variety of offerings such as:
- Yacht rentals for the day
- Evening sailings
- Business team outings
- Private gatherings
- Long-term yacht hires
We make all services available subject to our ability to do so, and external conditions. The provision of services may be altered or halted without prior notification.
3. Booking and Reservations
3.1 Booking Process
When arranging a charter, you must:
- Have attained the age of 18 years or more
- Submit exact and detailed information
- Pay the stipulated advance payment as detailed in your booking acknowlegement
- Concur with these Terms & Conditions
3.2 Confirmation
Confirmation of your booking is secured only when your payment has been received and acknowledged by us in written form. We retain the privilege to decline service at our discretion.
3.3 Availability
All yacht charters are relient on the availability of vessels and favorable weather. We will make every effort to accommodate your requested dates and times.
4. Payment Terms
4.1 Pricing
All quoted rates are in € and include all relevant taxes unless indicated otherwise. Rates can change with no prior notification.
4.2 Payment Schedule
- Deposit: 50% of the total cost of the charter, payable at the time of booking
- Remaining balance: Payable 48 hours prior to the departure of the charter
- Additional fees (if applicable): Payable after the charter's conclusion
4.3 Payment Methods
We accept major credit cards, electronic bank transactions, and certified cheques. Payment processing occurs via secure and encrypted platforms.
5. Cancellation and Refund Policy
5.1 Customer Cancellations
- More than 72 hours prior to departure: Full reimbursement less transaction fees
- Between 24 and 72 hours before departure: 50% refund
- Within 24 hours of departure: No reimbursement
5.2 Weather Cancellations
In the event the captain deems weather conditions to be unsafe, the following options will be made available:
- Reschedule of your charter to an alternate available date at no extra charge
- Issue a complete refund if rescheduling is not feasible
5.3 Mechanical Issues
In case of mechanical issues with the designated vessel, we will endeavor to provide an appropriate alternative. Should a replacement not be possible, a full reimbursement will be issued.
6. Safety and Conduct
6.1 Safety Requirements
All guests are required to:
- Obey all directions provided by the crew
- Don safety gear as necessary
- Disclose any health conditions that could impact their safety
- Stay within approved areas on the vessel
6.2 Prohibited Items
The following are not allowed on board:
- Containers made of glass
- Illegal substances
- Weapons or firearms
- Excessive amounts beyond reasonable consumption of soft drinks or lemonade
- Animals, unless given prior approval
6.3 Conduct
Passengers should behave respectfully at all times. Should passenger conduct present a threat to safety or disrupt others' experience, we may conclude the charter prematurely with no refund.
7. Liability and Insurance
7.1 Our Liability
We limit our liability to the amount you paid for the charter. We are not responsible for:
- Injuries caused by passenger carelessness
- Damage or loss of personal items
- Indirect or incidental damages or penalties
- Delays due to weather or events that are outside of our control
7.2 Insurance Coverage
Comprehensive marine insurance is in place to cover our vessels and operation. Guests are responsible for obtaining their own insurance for travel and personal effects.
7.3 Assumption of Risk
By taking part in our charter services, you accept that marine activities come with inherent dangers and you willingly assume responsibility for your own health and safety.
8. Modifications and Itinerary Changes
We reserve the authority to alter itineraries, paths, or schedules in response to factors such as weather, safety concerns, or operational requirements. We will strive to provide alternatives of similar quality.
9. Force Majeure
We shall not be held accountable for any delay, alterations, or cancellations brought on by circumstances outside our control, including but not confined to:
- Severe climatic conditions
- Natural catastrophes
- Governing mandates
- Harbor shutdowns
- Vehicular malfunctions
10. Privacy and Data Protection
Your privacy is respected and managed according to our Privacy Policy. By using our services, you grant consent for the use of your data as described in the Privacy Policy.
11. Intellectual Property
All material on our website, such as text, visuals, logos, and photographs, is secured by copyright and trademark laws. Unauthorized reproduction, distribution, or creation of derivative works is prohibited without our express consent.
12. Governing Law
The governing laws of Germany will apply to these Terms. Any disputes will be handled by the judiciary of Hamburg, Germany.
